This Privacy Policy describes how Digital Shelf Health (operated by KMCAMZ Enterprise LLC, "we," "us," or "our") collects, uses, stores, protects, shares, retains, and deletes information in connection with our e-commerce management and consulting services and our website at digitalshelfhealth.com (collectively, the "Services"). By engaging our Services or using our website, you agree to the practices described in this Privacy Policy.

1. Who We Are

Digital Shelf Health is an e-commerce management agency that provides marketplace management, retail media, digital shelf optimization, and related services to consumer brands. In the course of providing those services, we may access and process data on behalf of our clients, including data accessed through authorized marketplace accounts such as Amazon Seller Central.

2. Information We Collect

2.1 Information You Provide Directly

We collect information you provide when you:

  • Contact us or submit an inquiry — name, company name, email address, phone number, and a description of your business needs.
  • Engage our services — business contact information, company details, billing and payment information, and information necessary to onboard your marketplace accounts.
  • Correspond with us — emails, messages, and attachments you send to us.

2.2 Information Accessed Through Client Marketplace Accounts

When a client grants us authorized access to their marketplace accounts (such as Amazon Seller Central via the Amazon Selling Partner API), we may access and process data on the client's behalf, including:

  • Account performance data (sales, traffic, conversion metrics)
  • Product listings, catalog data, and inventory information
  • Advertising campaign data and spend
  • Order and fulfillment data
  • Customer feedback and review data (in aggregate, as permitted by platform policies)
  • Account health and compliance information

This data is accessed solely to provide the services the client has engaged us to perform. We do not use client marketplace data for any purpose other than delivering those services.

2.3 Website Usage Information

When you visit our website, we may automatically collect:

  • IP address and general geographic location
  • Browser type and operating system
  • Pages visited, time spent, and referring URLs
  • Device identifiers

We may use cookies and similar technologies for this purpose. See Section 8 for more detail.

3. How We Use Information

We use the information we collect to:

  • Provide, manage, and improve the services we have been engaged to deliver
  • Communicate with clients and prospective clients about their accounts, projects, and inquiries
  • Process billing and payments for our services
  • Comply with our obligations under applicable platform agreements, including Amazon's Selling Partner API Data Protection Policy
  • Detect and prevent fraud, unauthorized access, or misuse of our systems
  • Comply with applicable laws, regulations, and legal process
  • Improve our internal processes and service quality

We do not sell personal information. We do not use client marketplace data for advertising, benchmarking against other clients, or any purpose unrelated to the specific client engagement.

4. Confidentiality

We treat all client business information — including marketplace account data, sales performance, advertising strategy, and operational details — as confidential. We do not disclose client business information to third parties except as described in Section 5 or as required by law.

Team members and contractors who access client information are subject to confidentiality obligations. Access to client data is limited to personnel who need it to perform the relevant services.

[CONFIRM BEFORE PUBLISHING] If you have executed confidentiality or non-disclosure agreements with clients as a standard part of your engagement process, you may wish to reference that here.

5. How We Share Information

We do not sell, rent, or trade personal information or client business data. We may share information only in the following circumstances:

5.1 Service Providers

We work with third-party service providers who assist us in operating our business and delivering our services. These may include cloud storage and infrastructure providers, project management and communication tools, accounting and billing software, and analytics and reporting tools. Service providers are permitted to use information only as necessary to provide services to us and are contractually required to protect it.

[CONFIRM BEFORE PUBLISHING] List your key service providers here if you wish to be specific (e.g., Google Workspace, Slack, QuickBooks). This increases transparency and is considered best practice.

5.2 Amazon and Other Marketplace Platforms

Our use of data accessed through the Amazon Selling Partner API is governed by Amazon's Selling Partner API Data Protection Policy. We do not share Selling Partner API data with any party other than Amazon and the client on whose behalf the data was accessed, except as required by Amazon's policies or applicable law.

5.3 Legal Requirements

We may disclose information if required to do so by law, court order, or governmental authority, or if we believe in good faith that such disclosure is necessary to protect our rights, your safety, or the safety of others.

5.4 Business Transfers

If we are involved in a merger, acquisition, or sale of all or a portion of our business, client information may be transferred as part of that transaction. We will notify affected clients of any such change in ownership or control.

5.5 With Your Consent

We may share information with your explicit consent for purposes not described in this policy.

6. Amazon Selling Partner API Data Protection

We access Amazon Selling Partner data only through authorized API integrations and only on behalf of clients who have explicitly granted us access. Our use of Selling Partner data is governed by Amazon's Selling Partner API Data Protection Policy and Developer Agreement, and we comply with those requirements, including:

  • Using Selling Partner data only for the purpose for which it was authorized
  • Not combining Selling Partner data with data from other sources for purposes not permitted by Amazon's policies
  • Not using Selling Partner data to build competing products or services
  • Maintaining appropriate technical and organizational safeguards to protect Selling Partner data
  • Deleting or returning Selling Partner data upon termination of the relevant authorization or engagement, in accordance with Amazon's data retention requirements

[CONFIRM BEFORE PUBLISHING] Review Amazon's current Selling Partner API Data Protection Policy to confirm this section accurately reflects your current obligations and practices. Amazon updates these requirements periodically.

7. Information Security

We implement reasonable administrative, technical, and physical safeguards designed to protect the information we hold from unauthorized access, use, disclosure, alteration, or destruction. These measures include:

  • Access controls limiting data access to authorized personnel
  • Use of encrypted communication channels where applicable
  • Secure credential management for marketplace account access

[CONFIRM BEFORE PUBLISHING] Add or remove specific controls based on what you actually have in place. Do not claim certifications (e.g., SOC 2, ISO 27001) unless you hold them.

No security system is impenetrable. We cannot guarantee the absolute security of information transmitted to or stored by us. In the event of a data breach that affects your information, we will notify you as required by applicable law.

8. Cookies and Tracking Technologies

Our website may use cookies and similar technologies to understand how visitors use the site and to improve the user experience. You can control cookies through your browser settings. Disabling cookies may affect the functionality of certain parts of our website.

We do not use tracking technologies to build advertising profiles or sell data to advertisers.

9. Data Retention

We retain personal information and client business data for as long as necessary to:

  • Fulfill the purposes described in this Privacy Policy
  • Comply with our legal and contractual obligations
  • Resolve disputes and enforce our agreements

When information is no longer needed, we take reasonable steps to delete or de-identify it. For data accessed through the Amazon Selling Partner API, we follow Amazon's data retention requirements, which generally require deletion of Selling Partner data within 90 days of the end of the authorization, unless a longer retention period is required by law or permitted by Amazon's policies.

[CONFIRM BEFORE PUBLISHING] Confirm your actual retention practices. If you retain certain records for a specific period (e.g., financial records for 7 years), note that here.

10. Deletion Requests

Clients and website visitors may request deletion of their personal information by contacting us at legal@digitalshelfhealth.com. We will respond to deletion requests within a reasonable time and will delete or de-identify the requested information unless we are required to retain it by law or for legitimate business purposes.

For Selling Partner API data, deletion requests will be handled in accordance with Amazon's data retention and deletion requirements.

13. Children's Privacy

Our Services are not directed to children under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us at legal@digitalshelfhealth.com and we will take steps to delete it.
